Law and hearing update — October 21, 2026

Saratoga County, New York — adopted October 20; effective date pending verification. Resolution 308 adopted Local Law 7 of 2026, covering commercial sales and distribution of ordinary leaf, powder, capsules, extracts, concentrates, beverages, mitragynine, 7-OH and other kratom alkaloids. Personal possession is excluded. The law takes effect upon filing with the New York Secretary of State; filing has not been verified. The 30-day inventory-removal period does not authorize continued sales. Official adopted resolution, vote and law, pages 51–57.

Merrimack, New Hampshire — public hearing October 22, 7 p.m. Eastern / 5 p.m. Mountain. Proposed Chapter 195, Kratom Prohibition, will be heard in the Matthew Thornton Room, 8 Baboosic Lake Road. The draft prohibits extracts, enhanced or chemically modified products, capsules, tablets, liquids and drinks, with a narrow exception for unadulterated natural leaf and ground leaf for purchasers over age 21. Proposed effect upon passage; adoption is not verified. No remote testimony route or separate written-comment deadline has been verified. Official agenda · Draft and hearing notice.

Arlington, Washington — outcome pending official verification. October 19 council materials proposed a commercial sale, distribution and advertising ban covering botanical leaf, extracts, 7-OH and synthetic derivatives. Personal possession/use is excluded. The draft proposes November 18, 2026 as its effective date, but adoption and an executed ordinance have not been verified. Official proposal.

Expired opportunities: Iowa RA 26-323 / proposed rule 481—553.13 addressed adding MGPI, MGM-15 and MGM-16 to Schedule I; its October 20 hearing and 4:30 p.m. Central written-comment deadline have passed. These proposed additions do not themselves schedule botanical leaf or create a new 7-OH threshold. Official notice, pages 2231–2234. Edgecombe County, NC scheduled virtual comments October 20 at 7 p.m. Eastern on a proposed under-21 sales restriction and adulterated-product prohibition; the notice supplies no alkaloid thresholds, and adoption remains unverified. Official notice. Hillsborough County’s October 21 speaker-registration deadline has passed; A-5 sought authorization to advertise a tentative November 10 hearing, not enactment. Final action remains unverified.

These updates do not change Colorado law. This is a verified selection of developments, not a fresh verification of every state or locality. Older entries retain their review dates. Updated status above supersedes earlier pending-vote and open-deadline references below.

HEARING & MEETING UPDATE • OCTOBER 20, 2026

Where the next kratom decisions are being discussed

Verified opportunities below distinguish a public hearing from a council discussion or adoption vote. All times are local. Proposals are not current law; tentative dates require confirmation. This selection does not represent a fresh review of every state or locality.

October 20: Saratoga County — adopted; filing unverified

Resolution 308 adopted Local Law 7 of 2026. See the October 21 update above for the adopted all-form commercial ban, personal-possession exception and filing requirement.

October 20: Quincy, Washington — council discussion, 6 p.m. Pacific

Preliminary agenda item J-4, “Kratom Regulation/Ban,” follows the October 6 hearing and seeks council direction. This is not a newly scheduled kratom hearing or an enacted ban. Meet at City Hall Council Chambers, 104 B Street SW, Quincy. The agenda includes general public comment; no separate written deadline or remote participation route was verified. The staff item does not establish product thresholds or separately define MGPI, MGM-15 or MGM-16.

October 21: Hillsborough County, Florida — draft review, 9 a.m. Eastern

Agenda A-5 asks commissioners to approve a draft amendment to Synthetic Drug Ordinance 13-3, Chapter 36, Article VII, and authorize advertising a tentative November 10, 10 a.m. Eastern public hearing. That hearing depends on the October 21 vote; do not treat it as confirmed. The October 21 hybrid meeting is at County Center, second-floor boardroom, 601 E. Kennedy Boulevard, Tampa.

Speaker signup closes October 21 at 9 a.m. Eastern. Use the county’s official online form for in-person or virtual participation. On-site signup assistance is available 8:30–9 a.m. Written comments may be sent to [email protected]; no separate written deadline was stated. Confirm future November 10 location and participation arrangements after scheduling.

The draft exempts ordinary whole leaf and products not chemically enhanced, altered or concentrated for increased potency, while proposing warning signage for kratom retailers. More than 1 mg/g 7-OH in solids/powders, more than 1 mg/mL in liquids, or a mitragynine-to-7-OH mass ratio below 100:1 would be presumptive evidence of a chemically enhanced or altered synthetic drug. These are evidentiary tests, not automatic safe-harbor limits. Laboratory detection of named 7-acetoxymitragynine, MGM-15 or MGM-16 also creates presumptive evidence; MGPI is not expressly named. The ordinance number remains unassigned (26-_____). If ultimately adopted, it would take effect upon filing with Florida’s Department of State.

November 20: Warren County, New York — public hearing, 10 a.m. Eastern

Resolution 380 of 2026 introduces proposed Local Law 9, restricting sale, offers for sale and distribution of kratom across botanical leaf, extracts, isolated or concentrated alkaloids and chemically converted or synthesized products. The draft includes an FDA-approved/prescription exception. This is a proposed law, not an adopted ban. The hearing is in the Supervisors’ Rooms, Warren County Municipal Center, 1340 U.S. Route 9, Lake George, NY 12845. No remote route or separate written-comment deadline was verified. The draft would become effective upon filing with the Secretary of State if adopted.

Official resolution, hearing notice and proposed law

Also upcoming: Hamilton County, NY, November 5 at 11 a.m. Eastern; Tennessee workplace-program rule hearing, November 10 at 11 a.m. Central, with written comments through November 24 at 4:30 p.m. Central; and Ulster County’s proposed November 17 at 7:05 p.m. Eastern hearing, still pending confirmation. Full source links and details follow below. Ulster’s earlier October 20 hearing-setting resolution was postponed; it is not a current confirmed hearing.

NEWS & HEARING WATCH • OCTOBER 19, 2026

Federal notice published; proposed thresholds are not yet effective

DEA published revised notices on October 14. The 7-OH/MGPI proposal uses alternative triggers: either substance alone, or their combined amount, greater than 1 mg/g in solids or 1 mg/mL in liquids, OR a mitragynine-to-7-OH/MGPI mass ratio below 100:1. A temporary order cannot issue before November 13; that is not a guaranteed effective date. MGPI, MGM-15 and MGM-16 remain controlled under the August 26 order. Botanical leaf is not blanket-scheduled by this notice; below-threshold does not mean federally approved or safe.

State and local updates

  • Utah agency warning, October 5: Officials reported four deaths linked to products marketed as kratom or cat’s claw; testing identified MGPI and MGM-15. • Dutchess County, NY: The published adoption notice for Local Law 6 of 2026 targets concentrated/synthetic 7-OH and named derivatives while preserving adult access to natural leaf. Do not treat this as an all-leaf ban. Official adoption notice.
  • Pennsylvania: HB 2657 passed the House 202–0 on October 5 and was referred to Senate Health & Human Services on October 13. It remains a proposal, not current law; House passage alone creates no new sales or shipping restriction. Official bill history and current text.
  • Colorado: Bulletin 26-03, posted October 2, concerns kratom-containing alcohol beverages in licensed liquor commerce. It should not be described as a blanket ban on ordinary nonalcoholic leaf products. Official bulletin.
